TRADEMARK — REGISTRATION IN UKRAINE
1. WHY REGISTER A TRADEMARK?
Trademark registration helps you:
- Secure exclusive rights to your brand name, logo, or trademark;
- Officially confirm ownership of your brand at the state level;
- Prevent unauthorized use or registration by competitors;
- Obtain legal protection and the exclusive right to use, license, transfer, or prohibit the use of your trademark by others.
Without registration, there is always a risk that another party may register an identical or similar trademark before you. Recovering rights in such situations can be time-consuming, expensive, and stressful.
A registered trademark is an intellectual property asset that can be sold, assigned, inherited, licensed, valued, or contributed to a company’s authorized capital.
Trademark ownership in Ukraine is confirmed by a Certificate valid for 10 years, with unlimited renewals available. Information about registered trademarks is entered into the official state register.
A registered trademark or even a pending Ukrainian trademark application may also serve as a basis for international trademark registration in more than 100 countries.
2. WHO CAN REGISTER A TRADEMARK (in UKRAINE)?
A trademark in Ukraine may be registered by:
- Individuals (Non-residents);
- Companies and organizations (Non-residents);
- Multiple co-owners;
- Ukrainian residents;
- Foreign applicants.
An individual does not need to be a registered entrepreneur to own a trademark.
3. DOCUMENTS REQUIRED
To file a trademark application, the following information is required:
- Full name and address of the applicant (for individuals);
- Company details (for legal entities);
- A clear image of the logo or the trademark wording;
- A list of goods and/or services for which the trademark will be used.
The verbal element of the trademark may be in any language.
4. TRADEMARK REGISTRATION COST
Standard registration cost(for Non-residents): 700$ +
The fee includes:
- Preliminary search;
- Official government fees;
- Preparation and filing of the application;
- Prosecution of the application;
- Obtaining the registration certificate.
Additional costs may apply if:
- More than one Nice Classification class is required;
- The trademark is filed in color;
- Several applicants are included;
- Accelerated examination is requested;
- An office action or provisional refusal is issued;
- Third-party objections are filed;
- Applicant details need to be amended.
5. IMPORTANT INFORMATION
Can a logo and a name be registered together?
Yes.
Can the availability of a trademark be checked before filing?
Yes. A preliminary online search can be conducted quickly, while an official search provides a higher level of reliability.
Are annual maintenance fees required?
No. Renewal fees are paid once every 10 years.
Can goods, services, or the logo be changed after filing?
No. Material changes are not allowed after filing.
Can a pending trademark application be licensed?
No.
Can a pending application be assigned to another person?
Yes. Ownership of a pending application may be transferred, and additional applicants may be added in certain cases.
What if someone else tries to register a similar trademark?
An opposition or objection may be filed against such an application. Early action significantly increases the chances of success.
