Patent application PCT, national phase of Ukraine Data, conditions, legislation.

Ukraine has been a party to the PCT (The Patent Cooperation Treaty) since December 25, 1991.

The procedure for registration of an invention under the PCT application is not different from the national application of Ukraine.

The deadline for introducing the PCT application into the national phase of Ukraine is 31 months (may be renewed by 2 months).

The validity of temporary legal protection for an international PCT application begins from the date of publication of information about it by the Patent Office of Ukraine.

The term of validity of intellectual property rights to an invention is 20 years from the date of applying with the Patent Office of Ukraine. If an application is submitted based on an international PCT application, the term of a patent for an invention is calculated from the date of submission international PCT application.

An applicant for a PCT patent application in Ukraine can be any individual, legal entity, or group of individuals — non-residents of Ukraine.

It is not necessary to have an operating enterprise in Ukraine.

The application must be submitted to the Patent Office of Ukraine through the official patent attorney of Ukraine.

The required documents for the introduction of a PCT patent application into the national phase of Ukraine are:

• data on the international application (numbers, dates, bibliographic information);
• the text of the international application in English;
• the international search report;
• the opinion of the search authority on patentability;
• the title page;
• the letter of attorney to the patent attorney of Ukraine.

The application must be submitted in Ukrainian.

1. Translation of the application, registration and submission to the Patent Office of Ukraine.
2. Set up an application.
3. Payment of duties.
4. Corrections of the international application are possible after submission in Ukraine.
5. Formal examination.
6. Application for qualification examination.
7. Qualification examination.
8. Issuance of a patent.
9. If a refusal to grant a patent is received, corrections are possible (without going beyond the boundaries of the primary application).
10. The patent application of Ukraine can be officially accelerated.
11. A patent of Ukraine must be maintained every year.
