Copyright in Ukraine: Registration Procedure

Ukraine is a participant in international copyright conventions, meaning that copyrights originating from other countries are also valid in Ukraine.

Ukraine has the «Law on Copyright and Related Rights.» According to this law, any person is entitled to register their copyright. To do this, one must prepare and submit a prescribed set of documents to the Patent Office of Ukraine and pay the state fee.

Registration Procedure Timeline

The registration process typically takes 2-4 months.

Who Can Submit Documents?

• The author or group of authors (both residents and non-residents of Ukraine);
• Legal or physical successors (both residents and non-residents of Ukraine) in cases where the author transfers their property rights.

Required Documents

• Information about the author;
• Information about the work;
• A sample of the work in electronic form;
• A summary or annotation of the work;
• Proof of payment of the state fee;
• Power of attorney for a patent attorney (if necessary);
• Information about the successor (if transferring rights);
• Copyright agreement or copy between the author and another party (if transferring rights).

Results of Registration

The Patent Office of Ukraine will issue either a Certificate of Copyright Registration or a Decision on the Registration of a Copyright Transfer Agreement.

Details about the work, author, successor, registration number, and date are entered into the State Register of Ukraine for registered copyrights and copyright agreements. This information is also published in the official bulletin «Copyright and Related Rights» and made available on the official website of the Patent Office of Ukraine.

The cost of services and state fees for non-residents of Ukraine starts from 300 USD, depending on the type of work and chosen procedure (for the author or successor).

• Stage adaptations of literature and folklore;
• Derivative works;
• Collections, provided they result from creative labor;
• Translations for dubbing, voiceover, and subtitling of foreign audiovisual films in Ukrainian and other languages;
• Other works.
