A trademark is not just a logo or a name — it is the identity of a business, a symbol of reputation, trust, and innovation. It reflects the essence of your product or service and helps distinguish you from competitors. In Ukraine, protecting your trademark is essential, especially in a market that is growing rapidly and integrating with global business standards.
As the famous marketing guru Jeff Bezos once said, «Your brand is what other people say about you when you’re not in the room.» For foreign companies and non-residents, registering and renewing your trademark in Ukraine ensures that your brand’s reputation remains strong and well-defined in this dynamic market.
- Trademark Registration in Ukraine
The registration of a trademark in Ukraine follows the guidelines outlined in the Law of Ukraine «On Protection of Rights to Marks for Goods and Services.» Ukraine is a member of several international agreements, such as the Paris Convention and the Madrid Agreement, allowing foreign companies and non-residents to file trademark applications.
Non-residents can apply for trademark protection in Ukraine, just like local businesses, without the need for a local presence. The process involves several steps:
- Filing an Application: The application must be submitted to the Ukrainian Intellectual Property Institute (Ukrpatent).
 - Examinations: Ukrpatent will conduct both formal and substantive examinations to ensure that the trademark complies with legal standards and does not conflict with existing marks.
 - Registration: If the application passes all examinations, a registration certificate will be issued, officially granting trademark protection.
Once a trademark is registered in Ukraine, it is valid for 10 years, with the option to renew for an unlimited number of subsequent 10-year periods. This makes the trademark a long-term asset for your business.
- Trademark Extension in Ukraine
A trademark in Ukraine is not perpetual unless renewed. For foreign companies, the procedure for trademark renewal is straightforward but must be done with care.
Renewal must be requested 6 months before the expiration of your trademark. However, you can also renew your trademark within a 6-month grace period after the expiration, although an additional fee will apply for the late renewal.
The renewal process requires the submission of the following documents:
- A formal application for renewal of the trademark,
 - Proof of payment for the government fee,
 - (If applicable) a power of attorney in case you are acting through a representative.
While the process is simple, it’s important to follow the steps carefully to avoid delays or complications. For non-resident applicants, ensuring all required documentation is correctly prepared is crucial to securing the continuation of trademark protection.
- Fees and Costs
The fees associated with trademark registration and renewal in Ukraine are structured as follows:
- Our service fee for trademark renewal is $300.
 - The government fee for renewal depends on the number of trademark classes and starts from $300. If your trademark applies to multiple classes, the fees will increase accordingly.
 - The cost for new trademark registration is also based on the number of classes and other specific requirements, so each application is priced individually.
It is essential to be aware of these fees, as failure to pay the required government fee on time can result in delays in processing your application.
- Consequences of Missing Renewal Deadlines
Failing to renew your trademark on time can result in the loss of trademark protection in Ukraine. If you miss the renewal deadline, your exclusive rights to use the trademark will be forfeited, and others could potentially register similar marks. While re-registration is possible, it is a complicated process, and the trademark may no longer enjoy the same level of protection. As the saying goes: «Don’t cry over spilled milk» — but missing renewal deadlines can be costly, especially for foreign companies that risk losing their market position and the distinctiveness of their brand in Ukraine. - Intellectual Property in Ukraine: A Modern Perspective
Ukraine’s intellectual property laws have been continuously improving and are increasingly aligned with international standards, making the country an attractive location for trademark protection. The Ukrainian government has made significant strides in streamlining trademark registration processes, allowing foreign entities to navigate them more efficiently.
For non-residents, registering a trademark in Ukraine offers an opportunity to protect their brand in a country with a growing economy, access to regional markets, and increasing foreign investment. Intellectual property in Ukraine is recognized as a crucial business asset, and investing in trademarks here is not just a smart decision — it’s a visionary move for companies seeking to expand their global footprint. - How We Can Help
